Please read these Terms of Service ("Terms") carefully. By accessing, downloading, or using the software provided by Moonforge Arcade LLC ("Company"), including AEROVOID, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. License Grant & Restrictions

Subject to these Terms, Moonforge Arcade LLC grants you a limited, non-exclusive, non-transferable, revocable license to use our Services for personal, non-commercial purposes.

You agree not to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of our games.
Use our Services to harass, abuse, stalk, or harm another person or entity.
Exploit the Services for any commercial purpose without our express written consent.
Use any automated system (bots, spiders) to access our Services.

2. Intellectual Property Rights

The Services, including all content, features, code, graphics, and functionality, are owned by Moonforge Arcade LLC and are protected by United States and international copyright, trademark, and intellectual property laws. "Moonforge Arcade" and "AEROVOID" are trademarks of the Company.

3. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MOONFORGE ARCADE LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOONFORGE ARCADE LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE SIX (6) MONTHS PRIOR TO THE CLAIM.

5. Indemnification

You agree to defend, indemnify, and hold harmless Moonforge Arcade LLC and its officers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

6. Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by the laws of the State of Kansas, without regard to its conflict of law provisions.

Binding Arbitration: Any dispute arising from these Terms shall be resolved through binding arbitration conducted in Wichita, Kansas.

Class Action Waiver: YOU AND MOONFORGE ARCADE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
